Terms & Conditions
Introduction & Acceptance
Welcome to Sky Tea Company ("Sky Tea", "we", "us", or "our"). These Terms and Conditions constitute a legally binding agreement made between you ("Customer", "User", or "You") and Sky Tea Company Limited, registered under the Companies Act of the Republic of Kenya.
By accessing our website, browsing our catalog, enrolling in recurring artisanal subscriptions, or purchasing our high-altitude volcanic teas, you acknowledge that you have read, understood, and agreed to be governed by these Terms, together with our Privacy Policy and Fair Trade Commitments. If you do not accept these terms in full, you must refrain from ordering through this service.
Account & Eligibility
To make purchases or join the Sky Tea Connoisseur Circle, you must be at least 18 years of age or the age of legal majority in your domestic jurisdiction. When opening an account, you agree to:
- Provide accurate, current, and complete identification, shipping, and phone details.
- Maintain the confidentiality of your account credentials, password, and single-use security tokens.
- Accept full responsibility for all activities, checkout completions, and transactions conducted under your credentials.
- Immediately notify Sky Tea upon discovering any unauthorized entry or suspected breach of your customer account.
Orders, Pricing & Payment
All prices on Sky Tea are shown in Kenya Shillings (KSh) by default, with estimated foreign conversion equivalents provided solely for buyer reference (standard pegged baseline: 1 USD ≈ 130 KES, updated periodically). We reserve the right to revise harvest pricing without prior written notice to reflect seasonal agricultural yield fluctuations.
Transactions processed via Safaricom M-PESA require entering your active Safaricom phone number during checkout. You will receive an instantaneous STK push prompt on your mobile handset. You must authenticate the PIN request within 60 seconds. Once confirmed, you will receive an automated transaction reference matching our ledger. Credit & Debit cards (Visa, Mastercard) are authenticated using 3D-Secure 2.0 protocols through certified East African gateways.
Shipping, Delivery & Customs
Sky Tea dispatches freshly packaged leaf and spiced blends directly from our high-altitude packing facility in Limuru and our distribution node in Nairobi.
Deliveries within Nairobi Metropolis arrive within 24 to 48 hours. Regional deliveries (Mombasa, Kisumu, Nakuru, Eldoret) typically require 2 to 4 business days.
International shipments via DHL Express or Postal Air Courier require 4 to 10 working days. International buyers are solely responsible for local custom tariffs, import duties, and phytosanitary clearance declarations in their respective territory.
Returns, Refunds & Replacements
Due to strict food safety standards and the delicate botanical qualities of loose-leaf and grounded teas, specialized return parameters apply to all inventory.
In accordance with Kenyan consumer food protection regulations and international agricultural safety directives, opened packages, punctured pouches, or loose tea containers cannot be returned for resale or refund under any circumstance.
If an item is received mechanically damaged in transit, or if an incorrect blend (e.g. Pure Green instead of Tangawizi Chai) was dispatched, notify our quality assurance department at returns@skytea.ke within seventy-two (72) hours of confirmed courier drop-off, providing photographic evidence of pouch barcodes and outer packaging.
Intellectual Property & Brand Rights
All proprietary trademarks, service marks, logo designs, pouch packaging trade dresses, photographic compositions, typography stylings, harvesting research notes, and web elements are the exclusive intellectual property of Sky Tea Company Limited.
No part of the website, packaging designs, or promotional collateral may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, or licensed for commercial purposes without our express prior written permission.
Subscription & Tea Club Membership
By enrolling in a recurring Sky Tea subscription (e.g., Seasonal Origin Discovery Pouch, Monthly Tangawizi Chai Reserve), you authorize automated recurring charges to your chosen payment method on the cycle defined at signup (monthly or quarterly).
- Adjustment Period: You may pause, swap pouch sizes (100g, 250g, 500g), or adjust shipment frequency up to five (5) business days prior to your subsequent billing anniversary.
- Cancellation: Subscription cancellations can be executed directly from your account dashboard or via direct notification to care@skytea.ke. Pre-packed seasonal batches that have entered fulfillment before cancellation cannot be recalled.
Limitation of Liability
To the maximum extent permitted by applicable Kenyan law, Sky Tea Company Limited and its directors, employees, agricultural partners, and agents shall not be liable for indirect, incidental, punitive, or consequential damages resulting from product use or web availability.
Sky Tea guarantees the botanical authenticity, organoleptic quality, and sanitary packaging of our merchandise. However, individual sensitivities, spice allergies (including natural ginger, cinnamon, or cardamom traces), or improper boiling preparations remain at the discretion and responsibility of the consumer.
Governing Law & Dispute Resolution
These Terms, your interactions, and any procurement disagreements shall be governed by, construed, and enforced in accordance with the Laws of the Republic of Kenya, without regard to conflict of law principles.
Any legal dispute, controversy, or claim arising out of this agreement shall first be subjected to friendly, conciliated arbitration administered by the Chartered Institute of Arbitrators (Kenya Branch) in Nairobi, before resort to courts of competent jurisdiction.
